Terms of service

These terms govern the use of Nuurq (the "Service") by the business that creates an account ("you"). By creating an account, or by using the Service, you agree to them. If you are accepting on behalf of a company, you confirm that you are authorised to do so. The Service is provided by the operator of this deployment ("we", "us").

1. The Service

Nuurq is an AI customer-service agent. You upload documents, connect channels and configure how the agent behaves; the agent answers your customers on those channels, records conversations and captures orders, bookings and enquiries into your dashboard. What each plan includes — conversations, channels, knowledge storage, seats — is shown on the pricing page at the time you subscribe.

2. Your account

  • You must give accurate information when you sign up and keep it current.
  • You are responsible for everything done under your account, including by team members you invite, and for keeping passwords and credentials confidential. Tell us promptly if you believe your account has been compromised.
  • You must be at least 18 years old and able to enter into a binding contract.

3. Your API key and AI costs

The agent generates replies using Anthropic's models through an Anthropic API key that you provide. By providing it, you authorise us to use it solely to operate your account. You are responsible for the key, for Anthropic's charges for the usage it generates, for complying with Anthropic's terms, and for setting any spending limit you want at Anthropic. We store the key encrypted and do not display it after you save it. You may revoke the key at any time; the agent then stops answering until you provide another. Our subscription fees do not include AI usage, and we do not mark up or resell Anthropic's services.

4. Your content

You keep ownership of everything you upload or configure, and of the transcripts, orders and other records the Service creates for you ("Your Content"). You grant us a licence to host, process, transmit and display Your Content only as needed to provide the Service to you and to keep it secure. You are responsible for having the right to upload Your Content and for what you instruct the agent to say; you must not upload material you are not entitled to use, or personal information you are not entitled to share.

5. Acceptable use

You must not use the Service, or configure the agent, to:

  • break any law, including consumer protection, privacy, anti-spam, telemarketing and call-recording laws;
  • deceive people, including by presenting the agent as a human where the law requires disclosure, or by making claims about your products that are untrue;
  • send unsolicited messages, or message people who have asked you to stop;
  • breach the rules of the channels you connect, such as Meta's platform policies or your telephony provider's terms;
  • upload malicious code, probe or disrupt the Service, or try to access another account's information;
  • build a competing service by systematically extracting the Service's behaviour.

We may suspend an account that we reasonably believe is breaching this section, and we will tell you why unless the law prevents it.

6. Your customers

You are responsible for your relationship with your customers: for your own privacy notice, for obtaining any consent required before recording calls or messaging people, for telling customers that an automated agent is answering where the law requires it, and for honouring the orders, bookings and commitments you choose to accept. The agent is configured not to claim to be human and not to make binding promises on your behalf, but you must review what it captures before you act on it.

7. Plans, fees and trials

  • Fees are those shown for your plan when you subscribe, billed in advance for each monthly or yearly period, in the currency shown.
  • A free trial gives you a stated number of days and conversations at no fee. When the trial ends, the agent pauses until you choose a plan.
  • Each plan has limits — conversations in a period, documents, storage, seats, channels. When a limit is reached, the agent tells your customers it is temporarily unavailable rather than failing silently, and your dashboard shows you why. You may upgrade at any time; the new fee applies from the upgrade.
  • Where payment is collected manually, your plan is activated once payment is received. Where card payment is enabled, you authorise us to charge the card on file at each renewal.
  • Fees exclude taxes; where we must charge tax, it is added to the invoice.
  • We may change fees with at least 30 days' notice; a change takes effect at your next renewal after the notice, and you may cancel before then.

8. Cancellation and termination

  • You can cancel at any time from the dashboard. Your plan stays active until the end of the period you have paid for; we do not refund the unused part of a period unless the law requires it.
  • We may suspend or end your account if you breach these terms, if fees are unpaid after a reminder, or if we are required to by law. We may also end the Service as a whole with at least 60 days' notice, in which case unused prepaid fees are refunded.
  • After an account ends, we delete Your Content within a reasonable period, except what we must keep by law. Download what you need before you cancel.

9. AI output

The agent generates answers from the material you give it and from the conversation. It can be wrong, incomplete or out of date, particularly when your documents are. It does not give legal, medical, financial or other professional advice, and nothing it says is a commitment by us. You must check captured orders, bookings and any figure before you rely on it, and you remain responsible for what you tell your customers through it.

10. Availability and third parties

We work to keep the Service available and will tell you about planned maintenance where we can. The Service depends on third parties we do not control — Anthropic, Meta, telephony and speech providers, hosting — and it may be affected by their outages, changes or decisions. Unless agreed in writing, we do not promise a particular level of availability. Where a channel is unavailable, the agent's other channels continue to work.

11. Intellectual property

The Service, its software, design and documentation belong to us or our licensors. These terms give you a right to use the Service, not ownership of it. If you give us feedback or suggestions, we may use them without obligation to you. Your trademarks and logo remain yours; where your plan includes white-label branding, you grant us a licence to display them within your dashboard.

12. Privacy and confidentiality

How we handle personal information is described in the privacy policy, which forms part of these terms. We treat Your Content as confidential and access it only to provide the Service, to keep it secure, to support you at your request, or where the law requires. You agree to treat non-public information about the Service as confidential.

13. Warranties and liability

The Service is provided as it is. To the extent the law allows, we exclude all warranties not stated in these terms, including that the Service will be error-free or uninterrupted or that AI output will be accurate. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost business or lost data, and our total liability to you in any twelve-month period is limited to the fees you paid us for the Service in that period. Nothing in these terms limits liability that cannot be limited by law. You agree to compensate us for claims by third parties arising from Your Content, your customers or your breach of these terms.

14. Changes to these terms

We may update these terms. We will publish the new version here with a new date and, for changes that materially affect you, tell you by email at least 30 days before they take effect. Continuing to use the Service after that date means you accept the new terms; if you do not, cancel before then.

15. Governing law and disputes

These terms are governed by the laws of the place where the operator of this deployment is established, unless a written agreement between us says otherwise, and the courts of that place have jurisdiction. Before starting any proceedings, you agree to contact us and give us a reasonable opportunity to resolve the matter. If any part of these terms is found unenforceable, the rest continues to apply.

16. Contact

Questions about these terms go to the operator of this deployment of Nuurq, through the contact details shown in your dashboard.
